Legal Question in Criminal Law in Missouri

Parole Date

My fiance is in Moberly Correctional Center where he is serving a 26 year sentence for 3 counts of statutory rape and 1 count of incest. He is a first time offender and has a parole date of January 2004. Is it possible that he could be paroled at that time even though he has only been in jail for 2 years now?

Yes-

It is possible that he could be paroled at his first parole hearing. However, it is unlikely that he will. Unless there are certain situations that make cell space scarce, and he has been fully compliant with all programs, he is not likely to be paroled after serving only two years of a twenty-six year sentence.

He is viewed as a sexual predator, and will be dealt with differently than other convicts. I do not know if the nature of his acts, that are the basis of his conviction, are such that he would be considered a pedophile. If he is, the courts and many parole committees view it as a preclusion to commit similar acts again. That is to say, he will not be able to stop committing the illegal/immoral acts again. They will probably want to have more time to evaluate his behavior. Tell him to participate in any therapy they offer, even if he does not think he has a problem.
