What does pending application of warrant mean and can you be prosecuted for a second degree burglury or felony theft without someone pressing charges

The police provide the prosecutor's office with the information they have and the prosecutor decides whether or not to bring charges. If so, a warrant will be issued for your arrest. In criminal matters, it is the state (or county) against the defendant and the "victim" is really only a witness in the case against you. If you are in this situation, you should go aead and hire a criminal defense attorney. In many cases we are able to determine when the charges are filed and then arrange for a "voluntary surrender" or otherwise get the warrant cancelled so you can avoid the inconvenience of being arrested. If the charges are not filed then the attorney can refund your money, less a reasonble amount to pay for the time and effort expended.
