Legal Question in Criminal Law in Missouri
pleading quitly to something u didnt do
my fiance' pled guilty in 2004 to an assault charge in wich he didnt commit. When it went to court the person responsible for the charge said he didnt do it but when they told her she would be arrested for false whatever she said ok ya he did. he plead guilty to keep from spending more time in jail. I have read the docket entries on case.net and they state that he was put on probabtion then it has a bunch of random dates from 2006 til now about probation revokation. then theres a court date for dec. 08 and then one for jan 09. The one for jan they issued a warrant for failure to appear, one he was unaware of the court date. now he is in jail, with no bond, hasnt seen a judge, wont see one for awhile it sounds like, and when i called to talk to the prosecuting attorney i was told no one speaks to the prosecuting attorney. on casenet it says he was put on probabtion in 2005 and it was completed in 2006, the lady in the prosecuting attorneys office informed me that they can keep u on probabtion for however long they want to no matter what. we dont have a lot of money for an attorney and they say they wont give him one til he goes to court. is any of this legal??
