Legal Question in Criminal Law in Missouri
If the police have called you and ask you to come in regarding questioning about money stolen from your place of employment do you have to go to the questioning? Can they place a warrant out to have you brought in just for questioning? I am being told that it is in regards to the matter of theft and they just want to ask questions - what are my rights?

The fifth amendment to the constitution recognizes your right against self incrimination. You do not have to tlak to the police nor do you have to go in for questioning. If you have any suspicion at all that they might accuse you of stealing, DON"T GO WITHOUT AN ATTORNEY.

You have rights under the United States Constitution and the Missouri State Constitution, The most important right is your Fifth Amendment right not to incriminate yourself. In short, you should never make any statements or answer any questions for law enforcement officers under the circumstances you describe. They are not there to help you. They are not there to be fair with you. They are there to collect or even produce evidence with which to charge you and convict you of a crime. They can and quite often do lie, cheat and use deception and other techniques to compel you to make statements. Do not volunteer to meet with law enforcemtn authorites. They can take you into custody for questioning and they can legally hold you for up to twentyfour hours without any charges. If this happens, you should decline, politely, to answer any questions or make any statements unless and until your attorney is present. You may ask to call an attorney. Do not let them bluff or bully you into changing your mind. If they already have enough evidence to charge you, then they will charge you. My advice is even more important in the event that you are charged with a crime. Do not make any statements.
