The answer is: "It depends". Sometimes a person is charged with violating a municipal or county ordinance if the amount of marijuana is relatively small. Other times the person can be charged with a misdemeanor for violating the state statute. A person should definitely avoid pleading guilty (without a plea bargain) or taking a conviction on any of these charges. The municipal or county cases might result in a lesser punishment or lesser conditions of probation than the state charge, but any conviction on any of them would go on your record and would cause a great deal of trouble under various scenarios in the future. There is absolutely no doubt that a person charged with possession of under 35 grams of marijuana should hire an attorney.
