Possession of an Illegal substance/paraphanelia
My son was arrested for possession of marijuana and paraphanelia. First offense, no prior legal problems. Does he need a lawyer? How can I find out if this is a misdemeanor charge?

If it was my son that was charged with these things, I would hire an attorney.
You can tell if he is being charged with violations of municipal ordinances, county ordinances, or state statutes, by reading the charging instrument which might be a ticket, an information or even an indictment. If you do not have an attorney you may contact me for a free telephone consultation.

If you do not get a lawyer, your son will most likely be convicted of these charges and will face potential jail time, probation, a fine and will have this charge on his record. A good criminal defense lawyer should be able to get the charges reduced with a suspended imposition of sentence and no jail time. This could save your son from having this on his record.
