A person may be charged with "DWI" under a municipal ordinance, a county ordinance, the state statute, or even, in rare cases, under Federal law. The potential punishment a person faces depends on many factors including which law is alleged to have been violated, the defendant's criminal record or driving record, whether there was an accident, the particular Court the person must appear in front of, the particular prosecutor, and many others. So, you can see that it is difficult for an attorney to provide a very competent answer to your question without obtaining more information. The same reasoning would apply to some extent to the other parts of your question. If you have already been charged, an attorney would review the charging documents, e.g. the ticket, information, complaint or indictment. The attorney could then check the relevant laws and provide the answers to your questions.
