Legal Question in Criminal Law in Missouri

can i be released off of probation early if i have not gotten into any trouble no vialation. i have 5 years and i live in rolls mo and my case was in montgomery city. ive been on probation since oct of 2007 and know im on call in once a month. and if i cant how do i get off early.

Possibly. Some jurisdictions will allow an early release if there have been no violations and the defendant has fulfilled all his duties (paid fines, did community service etc.) Generally, this decision is up to the judge, who may ask the DA for input. First of all, there are no "DA"'s in Missouri. If you want to hire an attorney to pursue a Motion to Terminate your probation early, you are perfectly free to do so at any time. However, your odds of succeeding depend almost entirely upon the opinion of the prosecutor and of course ultimately the judge who put you on probation in the first place. The longer you have been on probation the better your chances, generally speaking. In some counties the judges simply do not ever grant such a Motion and so in those counties you would be wasting your money hiring an attorney.
