Legal Question in Criminal Law in Missouri

Sentencing for Rape of first time offenders

I have a dear friend who is in jail for rape. I want to know what are the chances of him getting probation for this charge? As I understand there are 3 counts against him.

Re: Sentencing for Rape of first time offenders

The answer depends on where the case is pending, what his prior history is and the ages of the persons who claim to have been raped. For example if these are charges that came up during a divorce they may be seen diferently than if he where cruising the streets.

The short answer is he could face 2 years probation (unlikley) up to 20 years per count if its simple sexual assault or life if its aggravated. The sentences could be stacked (finish one sentence then start the next) or run concurrent.

I would be happy to consult with you.

It is not possible for an attorney to provide competent legal advice responsive to your question without knowing all of the facts involved, and also knowing what court your friend is in, who the prosecutor is, who is the alleged victim, and many other things. If your friend has an attorney, then your friend should talk this over with his attorney.
