shop lifting

my sone is 20 yrs old, he got caught shop lifting at a Jc Penny's store he has no prior record of any kind. Would he need a lawyer?

The answer to your question depends on what your son was charged with. If you son was charged with something that he is willing to plead guilty to and pay a fine and have on his record then he may not need a lawyer. If you son is charged with something that could result in jail time or something on his record that he is not comfortable with, then he should probably at least consult with an attorney.

Also, it is important to note that oftentimes an attorney can negotiate a plea bargain with the prosecutor that will result in a much lower fine than if you simply plead guilty. Because of this, an attorney can often save you enough money on fines to justify the cost of hiring an attorney.

Yes, I would advise your son to hire an attorney because of the importance of the effect a conviction would have on his future and the fact that he would be more likely to avoid a conviction if he uses the services of an attorney. In some cases, it is possible for a first offender to obtain "supervision" from the court even without an attorney but this depends upon many factors not included in your question. At. the very least your son should consult with a criminal defense lawyer in the county where your son is charged with the offense. Good luck.
