Legal Question in Criminal Law in Missouri

My son recently received a SIS for tampering with a motor vehicle. He got 5 years probation and drug court He hasn't been showing up for drug court so he violated his probation. He was recently been arrested again for the tampering charge How can they do that when he has already pleaded guilty and received the probation. Does this mean they are revolking the SIS?

Yes, the probation officer and the prosecutor will ask the Judge to revoke your son's probation and the Judge is free to sentence your son to anything within the statutory range of punishment. In many cases a defense attorney can persuade the prosecutor to recommend and the Judge to aprove a deal under which your son's "SIS" may be converted to a "SES" (Suspended Execution of Sentence" after the Judge sentences him to some time. The result would be that you son would have a second chance on probation but would have time hanging over his head in the event that he violates again. He needs a good defense attorney to handle the revocation proceedings. If he doesn't already have one, and the case is pending in a court where I regularly appear, I may be able to help him.
