Legal Question in Criminal Law in Missouri
Spying Chiropractor
My husband and I were seeing a Chiropractor until he was arrested for taping his employees and patients in the restroom. He is being prosecuted for Invasion of Privacy. 2 questions:
1. What are our rights even if the detectives could not ID us on the tapes and computer?
and
2. We had pre-paid for a years worth of service, how do we go about getting our money back?

I would suggest that you have suffered injury due to the fact that your rights could have been violated even though you do not have video tape to prove any actual violation. The trouble is, how would you measure the damages for such an injury? If someone who was on the video tape filed a civil suit against the chiropractor, they would still have to argue to the jury that "they felt violated" or whatever, and ask the jury to compensate them in a reasonable amount. This would be very tough to do, and even tougher where you can not prove that you were videotaped without your knowlege or permission. Regarding your claim for refund of money paid for future services, you might want to write the chiropractor and notify him that, under the circumstances, you are terminating your agreement and requesting an immediate refund of all unearned money. If that doesn't get the cooperation of the chiropractor, then you could simply file a civil lawsuit to recover your money. I wish you the best of luck, however you elect to proceed.
