Unlawful use is usually a Class D felony, although under various circumstances it might be anything from a misdemeanor to a Class A felony. This means you face a range of one day to four years if it's a D felony, and anywhere from one day to life in prison under other circumstances. The ACA carries a mandatory three year imprisionment with no parole if you are convicted on the related offense.
