Legal Question in Criminal Law in Missouri

In the state of missouri can a sex offender live with underage children? Our 22 yr old son was arrested for sodomy with someone under the age of 17, He lives with us and we have 5 other sons ages 19, 17, 11, 9, and 2. He is to be released this week and we are wondering if he can come home or is that up to the judge to decide, thank you

There are certainly barriers to sex offenders cohabitatiting with minor children. Many convicted felons get some period of probation as part of a sentence. The Judge can order that the defendant refrain from living with minor children, or the Probation officer can require the same. If he served his full sentence and is getting out, then the restrictions are less. It is unclear whtehr the judge or anyone can forbid him from living with blood relatives. If he is paroled early, then there can stil be conditions of his parole that forbid him form living with non-re;ative children. It is unlcear if that can be extended to include siblings. Talk with the Court/probation,/parole staff, to see what restrictions they are requesting.
