statute of limitations on misdemeanor bad check
How does the statute of limitations apply here: A $49 check bounced Dec 23rd, 2005. The store owner took the check to the prosecutor 10 months later. (Incidentally I never got a letter from the store owner either. He had turned it over to a collection agency which is why the check wasn't paid to him already.) Our prosecutor did not file charges against me until May 21st, 2007. I just found out about it. She is filing it as a felony because the account was closed by bank on Jan 6, 2006. (I have proof and should beat that part of it, I hope.) Do you think she is insisting on the felony charge because the time limit on filing it as a misdemeanor has expired? Does the statute apply to the store owner or the prosecutor's filing the formal charge?? THANKS!!

You need to consult directly with an attorney in the area where you or the court are. It would be unwise to speculate as to why the case was filed as a felony, given the limited amount of space you have to provide facts.
