Legal Question in Criminal Law in Missouri
trespassing in Kansas City
I was arrested for trespassing on the sidewalk outside of a club after putting a friend in a cab and trying to return to the club to get my cousin whom I was staying with out there but did not know we had left. I was not thrown out of the club by the bouncer even though my friend was. I explained my situation but the police officer told me I was not allowed back in even though the club was still open to the public and that I could not wait on the sidewalk in front of the club for my friend. I did not know the area, i didn't know my cousins address, and i did not have a cell phone so I was stuck. As a result, i returned a short time later on the sidewalk and was arrested there for remaining on real property after being told by the police officer to leave earlier. Can a cop tell keep me from entering the club again and also force me to leave the sidewalk if i did not commit any offense? Can I be arrested for tresspassing on the sidewalk without entering the club? Should I get a lawyer or would a judge hear my story?

Re: trespassing in Kansas City
I have handled several trespassing charges from the new Power and Light District in Kansas City. For whatever reason, the bouncers and police seem to be issuing a lot of these. You will most likely need to retain an attorney to help you with this if you want to get the charges dismissed. Otherwise, the judge will most likely find you guilty of the offense in Municipal Court. You could appeal the Municipal Court conviction and have a greater chance of success in Circuit Court, but this would be expensive and risky for you. I would be happy to help you with this. Please let me know if you require assistance.
