Legal Question in Criminal Law in Missouri
vandalism
my son is being accused of vandalism of city property totalling about $3,000.00. He says he did not do it. Should I take a lawyer with us when we go see the detective? If so what kind should I take?

I have thirty plus years of experience in both juvenile and criminal defense law, and I disagree with Anthony Smith.Neither you nor your son should be going in to talk with any detective at all, ever! If they had enough evidence to charge and convict your sone, he would already be arrested and charged. The only reason a detective wants to talk with him is to gather more information to build his case against your son. The detective is not out to find the truth or to do what's right. He is out to arrest, charge, convict and punish.There are some very compelling reasons for the Constitution providing us the right to remain silent. I strongly advise your son to exercise that Constitutional right. I have represented hundreds of individuals who were convicted because they failed to do so. In the situation you described, it is probably best to take an attorney that has experience in juvenile law, or general criminal practice.
