Legal Question in Criminal Law in Missouri

Warrant for arrest

My husband bought an iphone off of

craigslist. After bringing it into

the store to find out why it acted

funny, he found out it was stolen.

The police questioned him at the

store and told him there is now a

warrant for his arrest and they will

get back in touch with him. We are

good people who have never been in

trouble and had no clue we would

ever be part of something like this.

What does this ''warrant'' mean?

What do we need to do? Will this be

on his record?

Re: Warrant for arrest

Either there was a misunderstanding, or the police just lied to your husband. If there had been a warrant out for his arrest, they would have arrested him then and there. They might have told him that they would be applying for a warrant. The police take the information they gather to the prosecutor who decides whether to prosecute. If so, a formal charge is filed, usually by the prosecutor filing a "complaint" or "information" with the Court, and they apply to the judge for a warrant. If a warrant is issued the police can come pick up your husband, call him and ask him to come in, or just wait until he is stopped on a routine traffic ticket at which time he would be arrested and taken into custody. You need to know what is going on, and you can not rely upon the police. Your husband should consult with an attorney. The attorney will find out whether any charges have been filed or any warrants issued. The attorney will also be able to get your husband through the entire process with the least amount of harm being done. Good luck!
