Legal Question in Criminal Law in Missouri
Weapons offense
Was arrested a while back on a weapons offense. Anyways the said ''weapon'' was a blank pistol gun that can fire nothing but blanks.Blank guns are commonly used in movies as stage props,or to start a race etc... They said they would contact me through mail if the prosecutor was going to press charges.Well about 6 months passed and I was calling the court to check on my traffic court date and the clerk advised me I had a felony warrant for my arrest. I was stopped by a diffent municipality a few weeks later for speeding. They ran my name and the warrant had me listed as ''armed and dangerous'' so the officer then called backup before he approached my car to arrest me and all their guns were drawn. My intentions with the gun was to get into video directing and start making my own small time films.I'm 18 (17 at the time of original arrest) and never been arrested for anything before. Why was I listed as armed and dangerous with a prop gun especially if it was confiscated and I didn't commit any crime at all with it. It was simply in my locked glovebox (so nobody got ahold of it at home :brothers, sisters). Now I am facing jailtime for nothing. Its not illegal to own or posess one in missouri you can buy one it a store. What should I do?
1 Answer from Attorneys
Re: Weapons offense
In the first place you need to hire an attorney to represent you. If you can not afford an attorney, ask the Judge to allow you to apply for the public defender. Your attorney will obtain all of the "evidence" the authorities have against you, and then advise you concerning your rights and your best course of action. If the charge is defensible, then it may be best for you to go to trial. If the charge is unsupportable, the prosecutor may be persuaded to drop it. In any event, I do wish you the very best of luck.
