Legal Question in Criminal Law in Missouri
What will happen if someone stole your check book, we already closed the account, because this isnt the first time this hasn't happened, but have never been able to catch her.She wrote a bad check not knowing the account was closed, but she has my husbands last name still so they took the check.She wrote the check to a pharmacy for your adderrall prescriptions. So, what I am askin is what charges will b pending againist her. We are gettin a copy of the check tomorrow and pressing charges. Since it it used to buy narcotics,will she get a chagre againist that too. plus the bad check and theft charges. Thank u so much! I need help ASAP!

I hope you have filed a police report and made an affidavit of forgery. Keep copies of barth as the pharmacy and any other person she wrote the check(s) to wmay come after you. If you have botjh thsoe items, you might be able to defend yourself in federal court. You might need to sue the defendant in civil court. If the Adderrall was for her or a family member, she can be found. The parmacy will likley try not to provide it so as nto to violate their HIPAA obligations. Therefore, Just trying to get that information from the pharmacy may prevent them from suing you for the bad check
Prosectuors have discretion in what chrges to file, so it may be impossible to accurately predict the extend the othe defendant's legal problems. She could get federal and state drug charges, as well as the fraud case. She might even get some distribution charges, if the drugs did not go to the named patient.
