Legal Question in Discrimination Law in Missouri
Comments of a personal nature while on-the-job
Inquiring on behalf of daughter "Sis"(age 29)who works in office of 6 employees. Boss's elderly mother (VP of company, not supervisor)entered Sis's office & voiced objections to her cullotte-type skirt, stating her "crotch was hanging out", and comparing her to former female employee who wore tight skirts & "let her butt hang out". When asked to clarify dress-code, she said "Don't get smart with me, Missy" & stated she'd "be ashamed" to let her represent the company. Daughter wears modest clothing & conducts herself as lady always! What should Sis do?

Re: Comments of a personal nature while on-the-job
This is a very sensitive situation. What the boss' mother did was uncalled for and could be considered discrimination but I do not know the laws in your state. If your daughter filed a formal complaint she may be fired, which is illegal but that does not stop companies from doing it and giving other reasons. However, I can understand if your daughter does not want to sacrifice her pride to save her job. If she wants to do something I would right a very polite letter to her supervisor asking for clarification of the dress code. She should explain politely what happened and how it made her feel. She could also explain that if she did wear inapproriate clothing it should have been brought to her attention by her superior. This should be done in a polite way. This way she is documenting what happened and making it known to her superior which will help her wrongful termination case if she is fired. She may also want to consult an attorney in her area to see what her rights are. Good luck.
