accident recovery
I was in an accident a week ago with a drunk driver, who was only 18 years old, as was one other passenger and the other passenger was 19. Their insurance company told me that my truck was a total loss, (and was paid for). My truck was 12 years old, and I know that now I will have to go in debt to get something of equal value and condition. Do I have any way of recovering what I feel is owed to me because a drunk driver took it away from me, or do I have to bite the bullet on this? I was not hurt at all, I am very thankful for that, I realize just 1mph faster and it would have been a totally different story. The accident happened in the state of Kansas.

If you dispute the value that the insurance company has given for yoru truck, you are not required tol accept their valuation. You can file suit against the other driver if your damages reach a certain amount. But, it is unlikely that it will get that far. If you can show that that other trucks like yours have been listed or sold for more than they are valuing your truck, they may relent.
