Re: drug charge?
First of all, try to remain calm. Although this can be a very serious situation, it is one that comes up all of the time and we can certainly handle it in a way that will minimize the adverse consequences. I'm not sure what you mean by "two twenty bags". Do you mean that each bag had twenty grams of marijuana? Or, do you mean that each bag would sell for twenty dollars? Or, do you mean something else entirely? If your daughter was charged with being in possession of more than 35 grams then she is charged with a felony. More specifically, this would be a Class C Felony which carrries a sentence of up to seven years. If this is her first offense and if the State has enough legally obtained evidence to convict, then it is very likely that she will be able to negotiate a plea bargain which will not only keep her out of prison but in many cases will avoid a conviction being entered upon her record. I have handled literally hundreds of these cases, and you may certainly contact me directly if you do not already have an attorney representing your daughter.
