The answer to your question depends upon a lot of facts that are not included in your post. Such facts are usually brought out by an attorney in an initial interview. For instance, the usual disposition (result) for a first time DWI would depend upon what court your case is in, what the prosecutor's office usually does with such cases, whether there was an accident involved, what other offenses you were charged with, what your overall driving record looks like, whether you took the breath test and if so what you blew, whether you were cooperative with the arresting officer, and perhaps most importantly whether or not the prosecutor can make his case. In most of the jurisdictions I practice in regularly, I am able to negotiate a plea bargain for my client, after I determine whether the prosecutor can make the case, under which the client pleads guilty but receives a suspended imposition of sentence (SIS) which has the effect of keeping a conviction for the charge from being entered upon the client's record so long as the client sucessfully completes two years of probation and performs all of the other conditions of probation required by the prosecutor or the Judge. These usually include the completeion of SATOP, attending a victim's impact panel, no drinking and driving or other offenses, and perhaps some community service.
