Legal Question in DUI Law in Missouri

dui charge

i was arrested for a dui and i wasnt driving. we ran out of gas and my boyfriend went to look for a gas station and i waited and put the hazerds on. the vehicle was not on nor was the keys in the ignition. i never told the cops where my boyfriend was or the situation. i was drunk didnt really know what was going on. i thought if i kept my mouth shut and waited tell i could talk to a lawyer that it would be fine. i dont think thats the case any more. my boyfriend said hes willing to testify. i was just wondering what are the chances i have fighting this.
