TIME IS OF THE ESSENCE. If you consented to chemical testing and failed the test, you must request an administrative hearing and prevail at said hearing. The request must be made within 15 days if you gave a sample of your breath, blood or urine. If you refused to take a chemical test, you have 30 days to file a petition in the circuit court.
