i have been charged with a dwi, but i had no alchol in my system, i have blood work proving so! Now the prosecutor is trying to switch the charge to a dui. I do take preciption medication, and i had been taking it the night of the occurence, but nowhere does it state that i should not or could not operate a vehicle. i am currently on probation in another county. it would be a first offence. What is the max sentence they can apply, and what is your recomendation?

My advice would be for you to hire the best defense attorney you can afford and discuss the matter with that attorney. Good luck.
