Legal Question in DUI Law in Missouri

out of state DUI

Resident of Ca. I went to MO to visit family. Passenger in parked vehicle (we were asleep). We both got DUI spent the night in jail and I flew back to Ca 2 days later. Court date 1st week of December. I dont know what the heck to do. Thank you in advance.

In twenty-eight years of representing defendants in DWI cases, I have never heard of a passenger, sleeping in a parked car being arrested for Driving While Itoxicated (Driving Under the Influence). There must be something more to the story. As you seem to know already, you should not just ignore the court date. If you do, then a warrant could be issued for your arrest. That warrant would go into one or more of three national data bases, and the next time you are pulled over or questioned by the police, wherever you are, they will know about the warrant. If you can not appear in Court in person, you should hire an attorney to appear for you and then no warrant will be issued. If what you say is true, it should be possible for your attorney to arrange for the charge against you to be dropped. You did not say exactly where you are supposed to appear in Court and this is very important. If this is a municipal court case, then you will save a good deal of money on attorney's fees. If it is a state court case then fees will be higher. If your court date is scheduled for a court in the Eastern half of the state, I can offer my services to you for a very reasonable fee, If the case is on the other side of the state, I would be glad to refer you to a good attorney. I would advise you to be careful of attorneys who use this lawguru website only to solicitate business. You can check "other answers by this attorney" on any attorney and tell who is trying to be helpful and who is only trying to lure in new clients.
