Legal Question in DUI Law in Missouri

Suspended Imposition of Sentencing Insurance

I'm facing a DUI charge as a 1st time offender and have been doing quite a bit of research on Suspended Imposition of Sentencing.

In Missouri how does SIS affect your auto-insurance?

If the SIS probation period is for 2 years, does the conviction show on your record for 2 years and then is erased?

Does it show on your DMV record for 2 years and then is erased?

Or does it never show on your record nor DMV if you complete the probation?

Thanks for your time.

You could be put on probation for the two years. No record of conviction if you comply with probation requirements, thereafter it totally disappears. I can help. Check me out at DUIattorneys.com or Injurylawstlouis.com

Re: Suspended Imposition of Sentencing Insurance

First of all, if you have an attorney you should get all of your legal advice from your attorney. If you do not already have an attorney, you definitely should hire one. the question you ask is really not a legal question, but more a question addressed to the actions of liability insurance providers. Still, I believe I can help you somewhat. If you plead guilty to the charge of DUI and the Court grants you a SIS, the legal effect of this is that you have no conviction on your record for the DUI. So long as you suceed on probation and fulfill all of your conditions then you will never have that conviction, and your insurance company will not be able to obtain your driving record, see a conviction, and raise your rates accordingly. What does happen, however, is that you probably received an administrative suspension of your right to drive. No driving at all for thirty days, followed by sixty days of some driving, followed by full reinstatement upon proof of insurance, completion of SATOP, and payment of a small fee. This will go on your driving record which your insurance company will see and they may raise your rates or even cancel you. Also, in order to get your license reinstated you will need to provide the Department of Revenue with an SR-22, which is a form provided by the insurance company, so they can get you that way as well. Some people with a lot of money purchase parallel coverage for two years and file the SR-22 from that company. I hope that this helps you understand things a little bit, and I am happy to help.
