Legal Question in DUI Law in Missouri

victim of drunk driver

I was hit by a drunk driver that was passed out when he hit me at 8pm. My car is totaled, and now I have mild whiplash, problems sleeping (due to nightmares, all I can see is that guy's head facing down as he hit us. I am in a great deal of agony as I am also concerned about his well being, he's in serious condition with multiple skull fractures and is still not conscience. His insurance company has provided me with a rental car, so they are being really good about things. I have been told that in order to retrive punitive damages, I will need a lawyer. Is this true? or can I wait and see what they offer, then if that doesn't sound appropriate then get a lawyer. I'm not to big on the idea of a lawyer, since they will take a portion of this money, and I don't feel a lot of work is needed in this case. Afterall, he was passed out drunk and crossed the median 100% his fault.
