can a attorney and trustee of a trust use a fraudulent lien as a insturment to bargan against probate hearing?

Attorneys are prohibited from committing a fraud upon a court. That includes a probate court. So, under teh facts you described, the attorney/trustee would be violating their obligation as an officer of the court, if they allege a fraudulent lein is a legitimate lien, in order to sway the court to take a certain course of action.
