Legal Question in Family Law in Missouri
Ok, So I have 50/50 joint and physical custody of my child. She is 3 years old. My ex has been dating a guy for 2 months and he is constantly with her and with my child. I finally got the background check back on him I secretly ran, and he has a criminal record and was incarcerated.
Can I get custody of my daughter due to her putting my child in danger?
This is what I pulled off the background check.
DWI confirmed 8/8/13
Assult 2nd Degree Operating vehicle while intoxicated resulting in injury. Served 120 days in prison. 11/25/2008
DWI Persistend OFffender 2/12/10
Is this enough for me to take my daughter? I am in Missouri. I do not drink, smoke, anything, nor have I. Furthermore I keep a journal of all the activities myself and my daughter do. I have a stable household and a steady job with good income. No criminal record.
I live in Missouri.
Should I lawyer up again and go further in debt and go for custody now?

It seems to me from the facts you have posted that you have an excellent chance of gaining custody, but it will be up to the Judge. As you seem to know, custody battles can be expensive, but, what is more important than the welfare of your child? I have handled literally hundreds of custody battles over the last 35 years, and I might be able to offer my services for a reasonable fee.
