Legal Question in Family Law in Missouri

17 year old moved out

My husband's 17 year old daughter moved out. She moved into his brother's house. Her mother has custody but we took care of her for 5 years without child support from her mom. The child support order for my husband was dropped 5 years ago. Can my husband drop his daughter's health insurance? Her mother doesn't contribute anything toward the care of her daughter. Now that she is 17 and living on her own (with no support from parents) legally does my husband have to continue to pay for her insurance?

Re: 17 year old moved out

I would want to review the existing Court Order(s) before I give you an opinion on your husband's legal rights or duties. From the facts you state in your question, it seems likely that the daughter would be "emancipated" under the law, but it might be advisable to take legal action to terminate any duties of support (e.g., carry health insurance)that your husband may still have. Please feel free to contact me for a consultation.
