i have a 4 year old son his father is in jail his name is not on the birth certificate and we have split up everyone one is telling me to file for full custody before he gets out he has never paid for anything for him do i need to file for full custody

Were you married to the man at the time the child was born? If so, then you may want to file for a dissolution of marriage which will include terms dealing with custody, parenting time, and child support. If you were not married, then you should file a suit to determine paternity. That suit will include terms dealing with custody, parenting time, and child support. In the meantime, you are the child's mother and you have custody. If the man in jail is not the legal father of the child then he has no rights concerning the child whatsoever.
