Legal Question in Family Law in Missouri
I'm a 35 yr old male. I have sole legal and primary physical custody of my 6yr old son (just started grade K). In our judgment, it specifies that mother is responsible for 35% of daycare and before/after school care costs. Upon leaving his daycare this summer, there was an outstanding balance of $350...all of it belonging to my X. I've paid her daycare debt numerous times in the past as she would usually just ignore it. She owes me (ordered in judgment) many thousands of dollars and is currently ignoring her portion of before/after school costs. Having said all that, here is my question: am I responsible for the outstanding $350 at daycare? I received a letter from said daycare today stating that it would be turned over to their attorney if not paid by November 6th. (five days from now).

If you enrolled your son in the daycare, then I would say, "Yes", you owe the money to the day care facility. They are not a party to the legal action between your son's mother and yourself. Why don't you take her back to court on a Motion for Contempt? These can be combined with a Motion for Money Judgment and you might be able to collect what she owes you.It would be best for you to hire an attorney. Good luck.
