Legal Question in Family Law in Missouri
We are trying to adopt a child but the mother will not consent. The grandmother is the child�s legal guardian and would also like us to adopt. The grandmother says she has proof that the mother is unfit. The birth mother wants nothing to do with the child but likes being difficult when it comes to the child�s best interest. Is there anything the child�s guardian can do to start the process towards adoption even if the birth mother is not cooperating?
I know the adoption process can be long but I am concerned for the child since the birth mother and the grandmother/guardian live together and are both addicted to drugs. I feel that the child is neglected and living in a harmful household. Since the grandmother is cooperating is she able to make any legal decisions for the child?

Before a child may be adopted in Missouri the interests of the mother and father have to be addressed. There is a way for your attorney to address both interests at once. They are too complicated to make a quiuck description here worthwhile. They will also have to deal wit the guardianship. the fact that she has a guardian, says that this child is already in the court's system. If you have not yet selected an attorney, I may be able to reccomend some.
