Legal Question in Family Law in Missouri
We adopted our grandchildren about 6 years ago. now, the biological mother is saying that one of the childs father is not the real father. does the real father have rights to the child even though the adoption is final?
1 Answer from Attorneys
If the father was given notice of the pending adoption, he probably will not be able to set aside the adoption. If the father wa sknown at the time, he may have been entitled to personal and specific notice,a ndhis parental rights may have had to been termianted by teh court prior to the adoption. If the father was not known, then he may have been given notice, anyway, if your properly advertised the adoption. You should discuss the type, frequency and palcement of the advertise dnotice with the attorney that represented you and the one that represented the child (Guardian Ad Litem) in the adoption.
Good luck
