Legal Question in Family Law in Missouri
Adoption of Boyfriend's Children
I have been dating a guy for 5 years he has 2 children that live with us. He does not have legal custody and the children barely see there mother. I take there of them emotionally, physically and financially. Most days I do more for them then there father. Is there anyway for me to become there mother on paper. I love these children and want to stay in there lives. I take better care of them then there dad and I love them dearly. I want to guarantee that I will always be there mom even if there dad and I split up. Please help

Re: Adoption of Boyfriend's Children
If you were to marry your boyfriend, and if you satisfied other legal requirements, you may be able to petition the Court for a "step-parent adoption". The natural mother would of course be entitled to notice and may either consent to or contest the adoption. If you are not going to marry your boyfriend, it is highly unlikely that you will be able to acquire any legal rights concerning the children. However, if both the father and natural mother are in effect "unfit parents" it may be possible for you to petition the Court for a "guardianship" and seek placement of physical custody of the children with you. In any event you would need expert legal advise and perhaps legal services. I would be willing to consult with you for a modest fee to cover my time. If you wish you may call me at 314-727-2822. Good luck!
