i was raped, i had a child, i have gotten married, my husband wants to adopt her, what legal rights does the rapist have

Yours is an unusual, but not totally unique situation. I am distressed to hear what happened to you.

Generally a father has the duty to support and the right to visitation. Activity or inactivity by the father can give a court reason to limit that right. If you can produce the police report where you reported the rape, and show that he has not provided financial support, you may be successful in getting the man's visitation cut of and/or his parental rights terminated(TPR). Your husband may then be able to adopt the child. The bilogical father will have to be given notice of the pending TPR and adoption actions. Sometimes this is just by way of an advertisement in a legal newspaper.
