Legal Question in Family Law in Missouri

Adoption w/o consent of bio-mother?

My X has not seen our daughter since 11/2005 and I have since been granted full legal and physical custody of my daughter and my X has lost all visitation rights unless visitation is agreed upon by me. She is an unfit mother who has been in and out of treatment programs and has documented mental issues. I am remarried and would like for my wife to adopt my daughter. My question is, considering the circumstances, would we have to have my X's consent in order for this to happen?

Re: Adoption w/o consent of bio-mother?

The mother's consent would certainly make everything go much easier, but I believe that it is possible to obtain a step-parent adoption in certain circumstances through a contested proceeding. You should consult with and hire an attorney who handles adoptions on a regular basis.
