Legal Question in Family Law in Missouri
At what age can a child choose which of the divorced parents they want to live with and what if any are the considerations
1 Answer from Attorneys
Missouri law does not allow any child of divorced parents to choose which parent the child wants to live with. Why would the law leave such am important decision to the child? The statute does provide that a Judge may consider the child's wishes in determining custody issues, but in my experience of over thirty-three years, very few Judges place much weight on this factor for a variety of very good reasons. Still, it is in the child's best interest for the terms of custody to be modified in many situations. If you believe that you may have one of those situations, you should consult with an attorney in your area to discuss all of the relevant facts and the potential that the Judge in your case would make a change in the existing custody terms.
