can the biological father sign his rights away to the man thats on the birth certificate? the mother is in prison and has already lost her rights to her other 4 kids

What rights? If a man's name is on a child's birth certificate that man is presued by the law to be that child's legal father. Any "biological father" does not have any legal rights to "sign away".
