Legal Question in Family Law in Missouri

Bitter Divorce - Find My Kids

A co-worker recently asked how difficult it was to find someone on the internet. After finding that person he said it was his son that he had given up 10 years prior in a bitter divorce. He has always wanted to see his son graduate. As long as the son has turned 18, are there any laws that prevent the father from contacting him? Going to his graduation? The ex-wife, son and another son under the age of 18 now live in Wisconsin. Does Wisconsin law affect the situation in any way?

Re: Bitter Divorce - Find My Kids

An attorney needs more specific information in order to provide any helpful response. If the coworker was divorced here in Missouri, then the Judgment or Decree from that court would tell us what rights belong to the coworker regarding his children. If that Judgment has been modified in any way at any time, we would need to see the most recent Court Order. If we assume that the Judgment simply gave custody to the mother with some rights of visitation, and there is no Order from any Court in effect limiting the coworker's contact with his children, then there is nothing stopping him from doing so. The fact that one of the sons turned 18 does not necessarily make any difference. Whether or not that son is emancipated and out of his mother's custody might make a difference depending on the details of the existing Court Order.
