Legal Question in Family Law in Missouri

My boyfriend and I found out that I was expecting, then he married someone else two weeks after we found out about our daughter, kept the marriage from me and when I found out our relationship ended. It has now been over 12 months since we found out about our child and she is now 3 months old and he still has not told his wife about me and is hidding our daughter from her. He is wanting to get visitation, but still hasn't told his wife... Is this grounds where I can ask for Sole Physical Custody? I believe I have to protect my child from the situation that can put her in a messy and hostile enviornment.

You need to consult directly with a family law attorney in your area There are to many variables to give you adequate advice here. Many attorneys offer a free or low cost initial consultation. Go see one and explain the support agreement or arrangement you have with the father. You may be able to get physical custody.

You can ask for sole physical custody but based on the facts as you've related them you likely wouldn't get it unless he simply does not fight it and agrees to your demands. If his wife does not have a violent background or one involving child abuse, a Court won't likely speculate about that as a basis to award you sole physical custody. There are other considerations, however.
