Legal Question in Family Law in Missouri
Breaking the divorce agreement
My ex-wife refuses to pay off a credit card that she had agreed to pay in our divorce agreement. Now the credit card company is threatening legal action against me since my name was the primary name on the account. Do I have anything to worry about? What can I do to stop the credit card from harrassing me, other than paying the debt myself?

Re: Breaking the divorce agreement
First of all, this is a very common scenario. The divorce decree does not relieve you from your liability to the credit card lender on the debt. The credit card lender was not a party to the suit for dissolution of marriage. Therefore, you may be held responsible and compelled to pay the debt. If this happens, you may be able to sue your ex for reimbursement based upon her breach of the separation agreement or refusal to comply with the court order. Also, you may be able to file a Motion for Contempt in the divorce court seeking to compel your ex to obey the court order.
