Legal Question in Family Law in Missouri

A buddy of mine is scared to death that his wife can have his and his girlfriend's email subpoenaed as a way to gather more information related to their affair. She has plenty from tracking software that she put on the family computer before he found out she had done this. Can she subpoena his girlfriend's yahoo account to get to their emails to each other?

It is very unlikely that a court will overrule a Motion to quash such a subpeona attempt. for this reason, most attorneys woudl nto even attempt such a subpeona. The girlfriend is not a party to the law suit, so she has not obligation to provide the information. Tell your "buddy" that his girlfriends' privacy is probably intanct, but his wife can get at any accounts that she is a partial owner of, such as the family account.
