As a practical matter, the answer to your question depends upon which County you are going to be filing your Petition for Dissolution of Marriage in, and which Judge is assigned to handle the case. Most of the Judges in St. Louis County, for instance, will allow us to file for the divorce so long as we add a count seeking a judicial determination of paternity in the other man's name. This means that you would have to serve the other man and prove that he is the father of the other child, which might require you to wait until the child is born.
