My son has his biological fathers last name. His father does not pay child support, and has not made any attempt at contacting me since January 6th, 2001. It has been 11 months, and I feel that my son should have my last name. I feel like this is in his best interest. His biological father has a criminal past, and is an alcoholic, and drug abuser. That is not hear say. Please lead me in the rihgt direction to proceed with this matter. Thank you.

In your question you do not state whether you were married to the child's biological father at the time the child was born. If so, are you now divorced? If there was no marriage, was there a Paternity suit under which the biological father was named the legal father by the Court? Or, did you receive some form of state aid with the Division of Family Services entering an administrative finding of paternity and ordering child support? Or, did none of these things happen? An attorney will need to know the facts before providing competent legal advice. If the biological father is not the legal father then all you may need is a relatively simple legal name change proceeding.
