Legal Question in Family Law in Missouri

Change Custody/Child Support

My ex and I have joint legal custody with myself paying child support. I live in Knox Co., my ex lives in Cole Co., we were divorced in Jefferson County. In December of 2003 my ex sent our oldest son to live with me,he is 14 and does not wish to leave, Her then husband did not want him around and he had started to exhibit irregular behavior. In january she had all of his information transfered here to me, medicaid, medical, school, and she told me she had contacted child support to discontinue that as well, we both decided to accept responsibility for the children we have. the short of it is that now CSE is contacting me threatening me with all kinds of bad stuff, saying she has decided to receive her child support. I am not a wealthy man but I need to fix this. Can I file a modification myself for the change in custody and child support. My youngest son is showing the same types of behavior now that his brother did and is asking to live here as well, he is 13. There is so much more here than I can put in a few words, long history, but really, neither of the children need to be there with her. Need some advice!

Re: Change Custody/Child Support

Yes, you are entitled under the law to file pleadings in court and represent yourself. But, why would you want to do that? Isn't the well being of your children important enough to hire an attorney to make sure that you obtain all of the legal relief you, and your children, need? A Motion to Modify seeking a change in custody and possibly an Order abating your child support obligation for any period of time over thirty days in which your ex voluntarily relinquished custody of your son to you will no doubt be a lengthy and hard fought proceeding. From your post it appears that this matter will be heard in Jefferson County no matter where the parties are living at this point, and I can offer my services to you in Jefferson County. You may call me for a free telephone consultation at 314-727-2822.
