Legal Question in Family Law in Missouri

Change of Jurisdiction (state)

My son and I have resided in Oklahoma for 4 years. Our divorce, however was in Missouri. My attorney says I have the keep the case in Missouri and I need to modify our Child Support, but think I should be able to do this in Oklahoma. How do I get my case changed over to Oklahoma?

If you have lived in OK for 4 years with your minor son, MO no longer has jurisdiction over anything dealing with your son. OK would have the jurisdiction. I do not practice OK law but you should be able to register the MO judgment and start a case there to raise child support. If that is the only issue you have, you may be able to do it through a gov. agency that handles child support matters. We have an agency in MO (through Social Services) that will look at the child support guideline and see if your child support should be raised and, if so, it will do all the paperwork for you. No attorney fees involved in the child support issue. If you need to modify visitation, etc. then you will need to hire an attorney and proceed through a court case. If there is anything that needs to be modified as to maintenance or assets, MO still controls and you will need to file a modification in MO. Hope this helps.
